The Nishiyama Family is extremely grateful and honored for efforts intended to keep the memory of Hidetaka Nishiyama alive. However, use of his trademarked material does require explicit written approval. The purpose of this is to ensure that Hidetaka Nishiyama's legacy is properly protected and kept in its truest form. The family owns various trademarks that incorporate the term "HIDETAKA NISHIYAMA", including pending federal trademark registrations in International Classes 9, 16, 35 (Serial Number 77777143) (collectively, the \"HIDETAKA NISHIYAMA\" marks). The estate is also the owner of all right, title, and interest in and to the rights of publicity associated with Mr. Nishiyama. These rights include the right to control the commercial exploitation of Mr. Nishiyama’s name, likeness, voice, image and other elements of his persona in advertisements, merchandise, and otherwise, including online via commercial websites and domain names (the \"Publicity Rights\").
